Who is responsible?

The Owners Corporation is responsible for the repair and maintenance of common property.

Generally speaking, in most strata schemes, the lot owner owns the airspace and everything in it within the boundary of the unit. The lot owner doesn’t own the main structure of the building.

We have put a quick guide below to help clarify who is responsible.

Ceiling

The Owners Corporation must repair the ceiling

Walls

The Owners Corporation must repair anything in the boundary walls, The lot owner must repair all walls within their lot.

Balcony door, flyscreen ,wall

If the strata plan was registered before 1 July 1974 the balcony wall including the windows and door and their working parts are generally part of the lot and the lot owner’s responsibility for maintenance and repairs (unless there is a notation on the strata plan or the balconies are not shown on the strata plan).

 

If the plan was registered after 1 July 1974 the balcony wall including the windows and doors and their working parts are generally common property and the owners corporation’s responsibility (unless the strata plan says otherwise). With the exception to flyscreens and/or security doors where they were installed by an owner after registration of the strata plan.

 

Carpet

The Lot Owner must repair and maintain the carpet within their lot.

The Owners Corporation will repair and maintain the carpet on common property such as carpet in the hallways.

Tiles

Original tiles on boundary wall and floor are the responsible of the Owners Corporation, all other tiles are the Lot Owners responsible.

Damp & Mould within lot.

The Owners Corporation is responsible for water penetration problems coming through an external wall or floor, the Lot Owner is responsible for the mould on their walls.

Burst Bathroom Pipe

If the burst pipe is in a boundary wall, the Owners Corporation is responsible, if it’s a internal wall then the Lot Owner is responsible unless the pipe services more than your lot, in which case this would be the Owners Corporation.

“S” bend under sink

The “S” Bend under the sink in the kitchen, Bathroom and laundry is the Lot Owners responsible

Block floor drain

The Owners Corporation is responsible

Cracks in walls

If cracks appear in the Owners Corporation wall and/or cornice and are less then 2nn thick, they are not deemed as damage and they become the Lot Owners responsible.
